During his Super Bowl performance, Kendrick Lamar cautioned against making defamatory statements about Drake.

Kendrick Lamar is set to headline the Super Bowl LVI halftime show at the Caesars Superdome in New Orleans, Louisiana, on February 9th. While the game will feature the Kansas City Chiefs against the Philadelphia Eagles, much of the buzz surrounds whether K.Dot will take the opportunity to diss Drake on such a massive platform.

Last year, the Compton rapper scored a number-one hit with his Drake diss track “Not Like Us.” In the song, Kendrick alleged that Drake is a “certified pedophile” and suggested he should be under “neighborhood watch,” along with other harsh lyrics.

Earlier this month, Drake filed a defamation lawsuit against Universal Music Group, alleging the label “approved, published, and promoted” a rap track as part of a viral campaign. He claims the song falsely accuses him of being a criminal pedophile and encourages vigilante action against him.

In an interview with The Los Angeles Times, prominent criminal defense attorney Ken White cautioned Kendrick against performing Not Like Us during the halftime show. “As a defense lawyer, my instinct is to say, ‘Guys, don’t do this—it’ll just be a headache for me,’” he remarked. He added that legal advisors for the network and the NFL are likely pleading, “No, for the love of God, don’t do it.”

He noted that the halftime show has a history of featuring somewhat edgy performances. However, he was unsure how they would handle this situation, adding that if he were an in-house counsel, he would advise against it.

Despite his remarks, he acknowledged that Kendrick faces minimal risk since he wasn’t mentioned in Drake’s lawsuit against Universal. “There’s some risk, but it seems low due to how Drake has approached this,” he explained. “Drake specifically targeted UMG and made it clear this isn’t about Kendrick.”

Drake’s approach seemed to be, “I’m not looking to feud with Kendrick, just with UMG.” The most he could argue is that “UMG promoted the song at the Super Bowl and played a role in securing Kendrick Lamar’s performance.”

Meanwhile, Drake won’t be in the U.S. during the Super Bowl, as he’ll be performing in Australia throughout February.
